Ramsey District Court has issued a temporary injunction on December 5, 2011. The will be no union vote in December. The issue will be heard again on Wednesday February 22, 2012. If a vote is to proceed, this page will be updated when the new information becomes available.

The Bureau of Mediation Services (BMS) is overseeing the voting process and the American Arbitration Association (AAA) is conducting the election.

- Each licensed family child care provider who meets the requirements of the Executive Order will receive a ballot with specific voting instructions printed in four languages (English, Spanish, Hmong, and Somali). Ballots have a control number on them to attempt to ensure votes being handled/counted appropriately.
- Eligible voters will be licensed family child care providers who were registered to receive CCAP payments on October 15, 2011, and received at least one CCAP payment in the prior 12 months. Eligible providers will include those not currently providing care if they meet the criteria of the cut- off date, have a current license, are registered with the CCAP, and received at least one payment in the prior 12 months.
- December 7: Ballot mailing begins.
- December 21: Ballot must be received in BMS/AAA office.

- A “majority” means: If only 100 of the 4,287 eligible providers return their ballots and 51 are “yes” votes, there will be union representation for all providers who have children on the subsidy program, and the union will negotiate on issues that will impact all 11,300 providers.
- No labor laws govern this union.
- No labor agency will monitor the unions’ activity.
- Providers will have no place to register complaints or file for union decertification.
- Over 60% of child care providers have been excluded from this vote. A successful vote means unions will be bargaining on issues that will impact 11,000+ providers. Union membership is voluntary; representation is not. The union will “meet and confer” on issues related to:
